Terms of Use

These Terms of Use govern the use of the SameSTORY app. By using the app, you declare that you have read, understood, and agree to these terms. If you do not agree, please do not use the application.

We wrote this in plain language on purpose — we want you to actually understand what you are agreeing to.

1. What the service is

SameSTORY is a remote shared-reading app: an adult (the Reader) reads a story aloud while the child (the Sonhador) follows the synchronized illustrations on another device. The app offers a catalog of original children's stories, device pairing, real-time synchronization, and — on the Premium plan — a live voice call during reading.

The application is operated by Gustavo Silva ("we"), available on the Google Play store under the identifier com.samestoryapp.app.

2. Who can use it

The app account is intended for adults (18 or older), who act as the responsible party: they create the account, set up the pairing, and, if they choose, purchase the subscription.

The child does not create an account or sign in. The child uses the app only through a device that the responsible adult deliberately linked (paired) using a code or QR Code generated in the adult's account. By pairing a device for a child, you declare that you are the child's legal guardian — or that you have the legal guardian's authorization — and that you authorize that child's use of the app under our Privacy Policy.

The app offers free access that lets you read a limited number of stories (currently 3 stories) and try the main features, including the voice call during that trial window.

The Premium plan is a subscription that unlocks the full story catalog and the voice call without a story limit. The available plans (monthly or annual), prices, and any free-trial periods are shown inside the app and processed by the Google Play store. Prices may vary by country and may be adjusted; any price change to an active subscription follows Google Play's communication rules.

6. Content and intellectual property

All stories, illustrations, characters (including Bebê Luca, Veloz, Dudu, Homem Catenga, Fernando, and others), texts, trademarks, logos, and other elements of the application are owned by us or licensed to us, and are protected by copyright and industrial-property laws. The trademark has been filed with Brazil's INPI, and works in the catalog are registered with Brazil's National Library.

By subscribing to or using the app, you receive a personal, limited, non-transferable, non-exclusive license to use the content within the application, for personal and family purposes. You may not copy, reproduce, distribute, sell, publish, adapt, or commercially exploit any content of the app outside of it, in whole or in part, without our written authorization. The printable coloring pages are intended exclusively for home and family use.

The voice call connects the adult's microphone to the child's device live, only during the reading session, and is not recorded (details in the Privacy Policy). The call can only be started by the adult. You are responsible for what you say during the call and for ensuring that only authorized people use the paired devices.

9. Privacy and children

The processing of personal data is described in our Privacy Policy, which forms part of these terms. In short: the child does not sign in, is not identified on our servers, sees no ads, and is not tracked. The account, the subscription, and all configuration decisions belong to the responsible adult.

10. Availability and changes to the service

We work to keep the app available and running well, but it depends on third-party services (internet, Google Play, cloud and voice providers) and may experience interruptions, maintenance, or occasional failures. We may add, change, or discontinue features and catalog stories. Changes that materially reduce what an active subscription offers will be communicated, and you may cancel if you do not agree.

11. Warranties and limitation of liability

The app is provided "as is". To the maximum extent permitted by law, we are not liable for indirect damages arising from the use of, or the inability to use, the application — such as loss of data saved only locally on the device, unavailability caused by third parties, or misuse of paired devices.

Nothing in these terms excludes or limits rights that consumer-protection legislation guarantees you and that cannot be excluded or limited by contract.

12. Termination

You may stop using the app and request the deletion of your account at any time (see the Privacy Policy). We may suspend or terminate accounts that violate these terms, especially the acceptable-use and child-protection rules. In case of termination for violation, amounts for periods already paid follow Google Play's refund policy and applicable law.

13. Changes to these terms

We may update these terms to reflect changes in the app or in the law. When that happens, we will change the "last updated" date at the top, and material changes may be communicated within the app. Continued use after an update means you agree to the new terms.

14. Governing law

These terms are governed by the laws of the Federative Republic of Brazil, where the service is operated. If you reside in another country, mandatory consumer-protection rules of your place of residence remain unaffected.
